Abstract :

Recently, many companies have left Indonesia due to the problems related to labors, known as industrial conflicts. Therefore there are two phenomena existed labor on strikes, and the industrial companies who left and canceled the contract, relocate, or cancel their investment plan. Those two phenomena have become the weapons of the two sides. The function of the weapons is to force the state. The state should take on a role of a mediator, but in fact, the state has usually escaped from its duty, when the phenomena happened. When the state did not escape, most of the time, the state was too late in its movement, so that the labors have reached the heated point, or the employer threatens to leave the contract. The unbalanced position between the labors and the owner of the company due to the penetration of the state and its instruments in the production did not change the situation. The state its involvement, and the claim of state development—should be neutral so that it can balance the unbalanced position between the labors and the industrial company. In fact, what happened is the strengthening of the political position of the industrial company, compared to the political position of the labors. Therefore, when “industrial relationship tension” is happening, then, the tension is not between the employer and the state, but between the labors against the employer and the state.
