Abstract :
The West Sumatera government desires to improve investment conditions in the province. This is inorder to increase employment opportunities, increase community income and to reduce the level ofpoverty. However, it is the opinion that opportunities have contracted and that the climate forinvestment is not optimum conductive. This is mainly caused by the uncertainty of land ownership.This research aims to investigate whether communal land ownership creates an unwelcome riskfactor for investment in West Sumatera. The investigation is using a qualitative research approachand is being carried out in the regency of Sijunjung. From the results of this research it appears thatcommunal land ownership is not being considered a negative factor to commence an investment. Theregulative convention applied by the community in the management of communal land usages givepriority to fair distribution of wealth and community justice. However for the investing communitythere are matters of concern which creates uncertainty for the investment to proceed. Stumble blocksinclude; the lengthy process to obtain approval from all members of the clan, clarity of authority ofthe members of the community and uncertainty of the precise boundary of the community property(tanah ulayat). The government has already attempted to reduce uncertainties and red tape forinvestors, but in some cases, investors have not considered this sufficient to proceed with theinvestment offer. Taking these considerations aside, economic opportunities remain open andpotential prospects of increasing productivity of community land (tanah ulayat) is possible, althoughin a constrained form.
