Abstract :

 dan tata negara Negara Madura tidak menjadi fokus permasalahan utama. Hampir seluruh topik dikaitkan dengan penafsiran dan cara membangun fakta melalui pendekatan politik bahwa Negara Madura adalah negara “boneka”. Oleh karena itu penelitian ini bertujuan untuk membahas mengenai sistem ketatanegaraan Madura  saat diterapkannya bentuk negara federal sejak tahun 1948 sampai 1950 di Indonesia dengan menggunakan metode sejarah. Permasalahan yang dikaji adalah mengenai bagaimanakah  sistem  ketatanegaraan  pada  Negara  Madura,  meliputi  bagaimana  bentuk  negara, sistem pemerintahan, serta kedudukan lembaga-lembaga negaranya. Dari hasil penelitian diperoleh kesimpulan bahwa Peraturan Tata Negara Negara Madura, terutama dalam pembukaannya banyak dipengaruhi  oleh  isi  yang  terkandung  dalam  Pembukaan  Undang-undang  Dasar  1945,  terutama dalam merumuskan tujuan negara dan dasar negara. Sistem pemerintahan yang dianut pada Negara Madura merupakan gabungan antara sistem pemerintahan parlementer dengan sistem pemerintahan presidensiil. Meskipun Negara Madura ini hanya berumur pendek, tidak lebih dari tiga tahun, namun sebenarnya negara ini telah memiliki peraturan negara yang disebut Peraturan Tata Negara Madura. Peraturan Tata Negara Negara Madura inilah yang dipersiapkan akan dijadikan Undang-undang Dasar Negara Madura. Akan tetapi, sampai negara ini bergabung ke Negara Kesatuan Indonesia ternyata peraturan ini juga belum disahkan sebagai UUD Negara Madura.Kata kunci: ketatanegaraan, Negara Madura, sistem pemerintahanAbstractMadura  state  was  hardly  studied  in  depth  by  many  historians.  If  there  had  been  a  study,  the governance system and constitutional system of Madura State would not have been the focus of the main problems. Almost all topics were associated with the interpretation of the fact that Madura State was considered as a “puppet” state. Therefore, this study aims to discuss the constitutional system of Madura state which was implemented from 1948 to 1950 in Indonesia. Specifically, the present study concerns how the constitutional system worked including the state form, governance system, and the position of the country’s institutions. The result of the study showed that the Rules of Procedure of Madura State were much influenced by the Constitution of 1945. The governance system of Madura State was a combination between parliamentary system and presidential system. Although Madura State was only short-lived, i.e. no more than three years, but this country had a state regulation called Rules of Madura State. These rules were prepared to be Constitution of Madura State. However, when Madura State joined in the Unitary State of Indonesia, the rules had not been legalized as constitution.
