Abstract :
This study aims to understand the role carried out by the Department of Trade and Industry of Surabaya in the Acquisition of mark rights for small and medium enterprise. Protection of mark rights is one way in which the Indonesian government to create a conducive business climate for small and medium enterprise sector, especially small and medium enterprises are innovative. This is in accordance with that set out in the Act No. 20 of 2008 on micro, small and medium enterprises. This study includes a descriptive study which refers to the theory argued by Fathorazi about the role of government. Informants in this study consisted of 3 employees of the Department of Trade and Industry of Surabaya, one person on the staff of the Ministry of Justice and Human Rights in East Java, and the 6 winners of Adi Cipta Karya award, who has never received assistance program of brand acquisition rights. Determination of the informants conducted by purposive sampling technique. While data collection techniques in this study conducted through in-depth interviews on the subject of research. Where the interviews were then processed and analyzed qualitatively.The results showed that the role played by the Department of Trade and Industry of Surabaya in the acquisition of mark rights for innovative small and medium enterprisess is to facilitate the acquisition of trademark rights, which in the facilitation program contained a number of activities that is characteristic of the function and role of government as a facilitator, which give something, give privileges, and create policies aimed at facilitating object
