Abstract :

Abstract:   In business competition, many found the alleged violations of the statute number 5/1999. One of them is a project organized by the National Gas Company (PGN). The PGN project is in the procurement pipeline for gas transmission projects offshore line ports Maringgai-Muara Bekasi to gas pipeline project South Sumatera - West Java (SSWJ) phase II PT PGN, tbk with Jobi Triananda as Project Manager. In the project, PGN directly pointing DNV Singapore as a consultant to conduct an assessment of the bidders factories pipeline project held PGN. Directly appointment of DNV Singapore is considered as a form of discrimination against other businesses, because the others are not given a chance to competed fairly. In the case of tender pipeline by PGN number court judgment 22/KPPU-L/2005, assemblies commission assessing the elements of Article 19 point d statute number  5/1999 was proved. Elements of Article 19 letter d includes elements of business, conducting both individually and collectively, elements other businesses, perform one or more activities, elements of which can lead to monopolistic practices, unfair competition element, and the element of discriminatory practice. PGN action points by directly appointment of DNV Singapore as a consultant to carry out an inspection of the bidder company is proven to cause monopolistic practices and or unfair business competition. Such actions do not reflect the principles of fair competition.   In accordance with statutory provisions, if PGN as entrepreneurs in this case does not accept the Commission's decision, it may rise an objection to the District Court within 14 days after receiving notice of the decision of the commission. In fact, PGN receives KPPU decision and run in accordance with the verdict.
