Sumpah pocong: upaya penyelesaian sengketa masyarakat madura (studi kasus di masjid madegan desa polagan, sampang madura)

Abstract :
Abstract This research is uncover and analysis of (1) how does the execution process of sumpah pocong. It includes kinds of conflict and reason behind the execution; (2) factors which lie behind the existence of sumpah pocong in Madura society and; (3) what is the meaning of sumpah pocong in Madura society’s culture. This research uses descriptive type of research and qualitative approach. There are several stages include in this research which are: (1) proposive select of research location in masjid Madegan desa Polagan Sampang Madura; (2) data are collect by observation and indepth interview; (3) seek informant (4) data analysis and interpretation. Concepts and law of cognition anthropology were added to this interpretation to compare and connect a set of data. This research reveals that (1) the are factors behind the execution for sumpah pocong such as : sumpah pocong is part of the tradition for conflict resolution ; problems resolved through aumpah pocong are tend to be accusation, as there is insufficient witness and evidence to be brought to the court of law ; reason to conduct sumpah pocong are mainly related to time, money effiency. (2)Parties’ problems solved through sumpah pocong usually supported by their relatives as conflict is always family’s matter and not personal. (3) The process of sumpah pocong is usually done through the use of particular meaningful behaviour and things. It is the symbol of sacred death as punishment from God. (4) The meaning of sumpah pocong is related to pride, dignity and shame. (5) Harmony is the effect of sumpah pocong, yet on the other hand there are part of the society that have to be isolated. This study is of significance to the religious leaders and village apparatuses to evaluate its execution. Socialization to use law as conflict resolution is need through ulama Keywords: ulama, socialization, sumpah pocong, conflict Abstrak Penelitian ini berupaya mengungkap (1) bagaimana proses eksekusi sumpah pocong; termasuk jenis konflik dan alasannya; (2) faktor-faktor yang mendasari eksistensi sumpah pocong dan; (3) apa makna sumpah pocong dalam budaya masyarakat Madura. Penelitian ini merupakan penelitian deskriptif kualitatif; tahapan dalam penelitian ini yaitu: (1) memilih lokasi penelitian di masjid Madegan desa Polagan Sampang Madura secara proposive; (2) mengumpulkan data melelui observasi dan wawancara mendalam; (3) mencari informan (4) analisis dan interpretasi data. Konsep antropologi hukum dan kognisi ditambahkan untuk menafsirkan perbandingan dan menghubungkan satu set data. Penelitian ini mengungkapkan bahwa (1) faktor-faktor di balik eksekusi untuk sumpah pocong seperti: sebagai bagian dari tradisi resolusi konflik; cenderung untuk menyelesaikan masalah tuduhan, karena ada tidak cukup saksi dan bukti untuk dibawa ke pengadilan; alasan terutama terkait dengan waktu, menghemat biaya. (2)pihak bermasalah biasanya didukung oleh kerabat sebagai resolusi konflik antarkeluarga dan tidak pribadi. (3) Proses biasanya dilakukan melalui penggunaan perilaku dan hal-hal tertentu yang bermakna simbol kematian yang suci karena hukuman dari Allah. (4) Arti sumpah pocong berkaitan dengan kebanggaan, martabat dan rasa malu. (5) Harmoni adalah efek dari sumpah pocong, namun di sisi lain ada sebagian masyarakat yang harus diisolasi. Studi ini adalah penting kepada para pemimpin agama dan aparat desa untuk mengevaluasi pelaksanaannya.
