Surakarta palace judicial system under colonial power

Abstract :

Abstrak Ada kontrol yang ketat pada sistem peradilan Kasunanan Surakarta sejak dulu. Hal ini terjadi karena pengadilan dan hukum berpihak pada sistem birokrasi pemerintah yang memberikan keuntungan di bidang politik, sosial dan ekonomi. Runtuhnya system peradilan disebabkan oleh sistem peradilan Keraton baik fisik maupun non fisik yang melemah seiring berkembangnya gerakan anti otonomi melawan feodalisme. Fakta sejarah peradilan di Surakarta banyak direkam dalam arsip-arsip kerajaan, dalam bentuk surat perjanjian antara Raja (Sunan) dengan pemerintah kolonial Belanda, Undang-undang hukum Jawa (Javaansche Wetten), Makloemat, Rijksblad Soerakarta, Adatrechtbundels, dan Staatsblad.  Dalam merunut kasus-kasus peradilan keraton Kasunanan, penulis memanfaatkan surat kabar lokal Surakarta seperti surat kabar Darmokondo, Bromartani, Soerakarta Hadiningrat, Pepenget, dan Soerat Kabar Pengadilan. Hasil penelitian menunjukkan terjadinya kontrol yang sangat ketat oleh pemerintah kolonial untuk melancarkan kepentingan ekonomi dan politik di wilayah jajahannya. Pemerintah kolonial memerlukan jaminan ketentraman dan kepastian hukum serta berusaha menekan bahkan mengurangi tingginya kejahatan di Surakarta.   Kata Kunci: Keraton Surakarta, kolonial, peradilan   Abstract There is a tight control on Kasunanan Surakarta judicial system for a long time. This happened since judicature and law content the government birocratic system, and describe the political, sosial and economics advantages. The collapsing judicial system is caused by either physical or non physical Kraton judicial system that became weaker as well as the growing of the anti-selfgoverment movement againts feodalism. The fact of judicial history in Surakarta were recorded in the archives of the kingdom, in the form of a letter of agreement between the King (Sunan) with the Dutch government, Java Act (Javaansche Wetten), Makloemat, Rijksblad Soerakarta, Adatrechtbundels and Statute. In tracing the court cases Kasunanan palace, the authors utilize local newspapers such as Darmokondo Surakarta, Bromartani, Soerakarta Hadiningrat, Pepenget and Court letters. The results showed the occurrence of very strict control by the colonial government to launch economic and political interests in the colonies. The colonial authorities require a guarantee of peace and rule of law as well to suppress and even reduce the high rates of crime in Surakarta.   Keywords: colonial, judicial system, Surakarta palace
