Abstract :
In the 1980’s, to combat the HIV-AIDS in their country, Brazil proposed the Sistema Único de Saúde (SUS), a medical care which give free medicines forpeople who lives with HIV-AIDS. Since ratifying TRIPS in 1996, the price of antiretroviral medicine (ARV) was expensive whereas it has been used asmedicine by the Brazilian government. So that’s why the Brazil’s Government was apply a compulsory licence to pressing the ARV’s price, but the UnitedState’s Government was considere that policy is contravene with TRIPS and harmed the pharmaceutical company from United State. This research wasexplain how’s the Brazil Government’s strategy to face the US’s pressure and their efforts to solve the HIV-AIDS as the country’s responsibility commitment.With the national interest concept and theory of strategy, diplomacy, and negotiation, it can be concluded that Brazil’s Government was using theeconomic diplomation theory by negotiation of decrease the ARV price with the pharmaceutical company as the holder of ARV’s patent right to face theTRIPS and was eliminate the US’s demand.
