Abstract :

This paper discusses about the validity of Intellectual Property Rights (IPRs) thatseems to limit technology transfer and trade in those days of free trade globalized.United States granted IPRs on aromatic rice (Basmati) thus harms India’s export andmight lead to biopiracy. To that end, the first will be generated about the propositionson IPRs. The second will be explained about the IPRs related to the common resourceand biodiversity. Then there is an explaination about the trade of patented ricearomatic. The next section deals with Indian efforts to withdraw the patent for thesake of geographical indication and protecting the national export. Lastly, it can beconcluded that the international trade could be harmed by the enforcement of IPRsthus need a new paradigm of IPRs.
