Abstract :
This research analyzes about the problem coming out from Brazil’s success on winning a dispute over the case of EU sugar export subsidies in the WTO in 2001 to 2006. This exceptional case happened as Brazil was actually included in the category of developing countries. Developing countries’ effort in resolving agricultural-related case disputes at the WTO usually face difficulties and do not result in a solution. Developing countries tend to be only able to complain but not until come to the final stage of dispute resolution cases. Brazil succeeded in resolving the dispute over the EU sugar export subsidy case that is producing a sanction decision by the WTO. The sanction demands EU to reform the sugar policy of its sugar regime. The success in winning the dispute over the EU sugar export subsidy case was afforded by Brazil by utilizing the end of the Peace Clause in 2003 and cooperating with governments and non-state actors to coordinate in preparing the necessary evidence to win the dispute Case of EU export subsidy. Brazil was also supported by ICONE funding during the case dispute resolution process. The concept of role of chance from Michael Potter was used to explain the application of the utilization of the end of Peace Clause in 2003 and the concept of cooperation which was applied through the concept of negotiation.
